SANESA Terms & Conditions
TERMS AND CONDITIONS 2025:
I/We declare that all particulars and information supplied
on the SANESA website are accurate and true and I/we hereby agree to be bound by
the SANESA Constitution, Rules
and Regulations and this Code of Conduct, which governs all aspects of SANESA.
Any submission of any entry
form or registration form, whether
electronically or by any other means, will be seen as an acknowledgment and
acceptance by the parents/guardian of the rider,
and the rider, of this Code of Conduct, together
with any SANESA
indemnity as stated
on any schedule or entry form, as well all conditions, rules, regulations or provisions stated in
the SANESA website, Constitution and
Rules and Regulations.
The following rules, policies, and disclaimers shall govern and/or
apply:
A. BY REGISTERING AND PARTICIPATING:
1.
You agree that,
although all care is taken for the riders/spectators and ponies/horses safety and welfare,
all equestrian activities/events are partaken in at the sole
risk of the rider/parents/guardian, instructors/coaches and pony/horse owner,
and that all parties hereby indemnify, defend and hold harmless SANESA, the SAEF, Relevant National Discipline
Associations, SASCOC, DBE and SRSA, its agents, employees, officers, officials,
members, independent contractors, volunteers
or any other persons associated therewith:
a.
for any loss, damage
or injury, including consequential or non-consequential losses, whether
directly or indirectly suffered by or caused to any person or property
on or about the property
or premises on which any SANESA event,
competition, match, practice
or related activity
or any other activity of
SANESA of whatsoever nature is held;
b.
in the event that,
whether directly, indirectly or not, such loss, damage or injury is occasioned
by any act or omission of SANESA, its agents,
employees, officers, members,
independent contractors, volunteers or any other persons associated therewith or for whose actions
they or any of them would be liable in law, or by reason of vis major, casus fortuitus, rain or other
water damage, riots, strikes,
theft or burglary (with or without
forcible entry), or by any reason or any condition on or off any
grounds, building structures, premises or facilities on or about which any
SANESA event, competition, function
or meeting of whatsoever nature is held, or caused by any sporting activity, or
by any other cause of whatsoever nature
and howsoever arising.
2.
All venue
owners and riders/parents/guardians are personally responsible for any damages
to third parties
caused by themselves, their employees, their agents or their pony/horse. They are therefore strongly advised to
take out public liability insurance providing full coverage for participation
in any equestrian event and to keep
the policy up to date.
3.
NO rider, learner,
parent, committee member, official/judge or teacher may sell, consume or
promote alcohol at any given SANESA event. Although
it is preferred not to have any
alcohol at any SANESA event, venues with legal liquor licenses will be permitted to trade but shall submit
a copy of their
liquor license to the Regional and/or Provincial
chairperson prior to any show. Any such venue shall strictly apply the law in
refusing to sell alcohol to minors.
4.
Only stallions whose riders/owners have completed and submitted a “Stallion Indemnity
Form (as found on the SANESA
website) to the National
Office AND Regional/Provincial committee, may compete
in a SANESA show.
5.
Registering and/or
entering riders and/or
ponies/horses under different
ID numbers (knowingly
or unknowingly) is
considered to be fraudulent and disciplinary action in terms of the SANESA Constitution
and Rules and Regulations can and will be a consequence.
6. SANESA reserves the right to assume the exclusive defence and control of any matter subject to indemnification by you.
B. CONDUCT:
1. All Riders who compete or participate in any SANESA event, by virtue of their entry for such event, hereby
acknowledge that they have read the “Athlete’s Code of Conduct”, as
published on the SANESA Website, and agree to be bound thereto in all respects.
The rider’s entry to any SANESA event will constitute an automatic acceptance of the “Athlete’s Code of Conduct”,
irrespective of the fact that they may not have uploaded a signed version of
the Code onto their
Rider’s profile, as they are required to do.
2. All Parents/Guardians
of any rider who compete or
participate in any SANESA event, by virtue of their minor child’s entry for
such event, hereby acknowledge that they have read the “Parents
Code of Conduct”, as published on the SANESA Website,
and agree to be bound thereto in all respects. The minor child’s entry to any
SANESA event will constitute an automatic
acceptance by the parents/guardian of said minor
child of the “Parent’s Code of Conduct”, irrespective of the fact that they may not have uploaded a
signed version of the Code onto
their child’s Rider’s profile, as they are required to do.
C. PAYMENTS:
1. Entry fees must be paid into the SANESA bank account:
First National Bank, 4 Merchant Place Branch Code: 200 607
Account Number: 6232 9526 448.
1. Reference on ALL payments must be the rider’s UNIQUE ID NUMBER as indicated on the entry form (i.e. R-GN1234) ONLY and WITHOUT spaces.
2. Payments MUST be received in the SANESA bank account, ON or BEFORE the closing date of entries.
3.
Payments made into other bank accounts
will be considered “Non-payments” by SANESA.
4.
In the event that the
incorrect reference has been used on a payment to SANESA, until such time as
the Rider/Parent has been able to provide proof of the payment to SANESA,
who has been able to identify said payment and allocate it accordingly, SANESA
have the right to deem such
payment as not having been made,
and to follow its procedures accordingly.
5. Riders with any outstanding fees will not be allowed
to enter any subsequent SANESA shows, and SANESA reserves
the right to block any Rider’s Profile
where
outstanding entry
fees have not been settled
in full.
6.
It
is the riders/parents responsibility to resolve payment
queries prior to the day of the show.
7.
Any fraudulent proofs of payment
submitted or forwarded
to SANESA, and which are not in fact proper
bank generated proofs
of payment, will be viewed
in the most serious light, and SANESA reserves the right to follow any
appropriate disciplinary procedures where such fraudulent conduct is detected.
D. WEBSITE:
1.
BY USING
THE WEBSITE (including,
without limitation, any bulletin boards, BLOGG, SANESA
Facebook pages or any other social networks on this website), you
agree, that:
a.
you will not use the SANESA
website to post any material
that is knowingly or unknowingly false and/or defamatory, inaccurate, abusive, vulgar,
obscene, profane, hateful, harassing, sexually oriented, threatening,
invasive of one's privacy, or otherwise in violation of any law;
b.
you will not knowingly
or unknowingly restrict
or inhibit any other user from using
and enjoying the SANESA website
provided hereon (for example,
by means of hacking or defacement);
c.
you
will not post any copyrighted material on the SANESA website
provided hereon unless
you own the copyright in and to such material;
d.
you will not post or transmit
any information or software that contains a virus, worm, time bomb, cancelbot, trojan
horse or other harmful,
disruptive, or deleterious component;
e.
you
will not post or transmit
materials in violation of another party's
copyright or other
intellectual property rights;
f.
you will not utilize
any robot, spider,
site search/retrieval application, or any other manual
or automated technique
to scrape, index,
data mine, etc., or in any way reproduce or circumvent the navigational structure or presentation of the SANESA
website or the contents of such website
or services; and
g.
you
will not impersonate any other individual or entity in connection with your use of the SANESA website.
h.
You may download material
intentionally made available for downloading from this website
for your personal,
non-commercial use only,
provided that you keep intact
any and all copyright and other proprietary notices that may appear on such
materials.
i.
Posting of advertisements, chain letters, pyramid
schemes, solicitations, and the like, are inappropriate and forbidden on the SANESA
website (including bulletin
boards and BLOGGS).
2.
SANESA has provided
links and pointers to internet sites maintained by third parties ("third
party sites") and may, from time to time, provide third party materials
on this website. Neither SANESA,
the SAEF, relevant
National Discipline Associations, SASCOC, DBE or SRSA, nor their affiliates, operate or control
in any respect any
information, products, or services on these third party sites.
